This Indenture made the Ninth day of October One thousand eight hundred and ninety seven Between William John Macqueen of Army and Navy Mansions Victoria Street Westminster in the County of London Brick Merchant (hereinafter called "the Mortgagor") of the one part and John Edward Ford of 1 Westbourne Gardens Porchester Square Bayswater in the County of London (hereinafter called the "the Mortgagee") of the other part

Witnesseth that in consideration of the sum of Seventeen thousand seven hundred and forty pounds paid to the Mortgagor by the Mortgagee on or before the execution of these presents (the receipt whereof the Mortgagee hereby acknowledges) the Mortgagor hereby covenants with the Mortgagor to pay to him on the first day of April one thousand eight hundred and ninety eight the sum of Seventeen thousand seven hundred and forty pounds and also so long after that as any principal money remains due under these presents to pay to him by way of interest thereon the following sums that is to say the sum of one shilling for the year ending on the First day of October One thousand eight hundred and ninety eight the sum of Two hundred pounds for the year the sum of Four hundred pounds for the year ending on the First day of October One thousand nine hundred the sum of Six hundred pounds for the year ending on the First day of October One thousand nine hundred and one and so long after the said First day of October One thousand nine hundred and one as the aid principal sum of Seventeen thousand seven hundred and forty pounds remains due under these presents the sum of Seven hundred and ten pounds per annum

And also that the said several sums payable by way of interest shall be paid by the Mortgagor to the Mortgagee by equal quarterly payments on the First of January the First day of April the First day of July the First day of October in every year

 

And this Indenture also witnesseth that for the consideration aforesaid the Mortgagor as Beneficial Owner hereby conveys unto the Mortgagee

Firstly All that piece or parcel of land situate at Clayhill Tottenham in the County of Middlesex containing by admeasurement Seven acres and three roods or thereabouts and bounded on the North Clayhill Road on the East by land belonging to the Ecclesiastical Commissioners and on the South and West by the premises secondly hereinafter described which piece or parcel of land with the dimensions thereof is more particularly delineated and described in the plan drawn on the Conveyance thereof to the Mortgage bearing the date the twelfth day of May One thousand eight hundred and ninety seven and therein coloured pink

And secondly all those pieces or parcels of land hereditments and premises situate at Clay hill aforesaid containing twenty seven acres and three roods or thereabouts and on the North side of White Hart Lane together with all messuages and tenements and outbuildings thereon which said premises secondly described and intended to be hereby conveyed are more particularly delineated and described in the plan drawn on the Conveyance thereof to the Mortgagor bearing the date the Eighth day of October One thousand eight hundred and ninety seven and thereon coloured pink as the same hereditments and premises firstly and secondly described are known as the Devonshire Hill Estate and were formerly described as

"Firstly All that piece or parcel of land situate at Tottenham in the County of Middlesex containing by admeasurement one rood five perches forming a portion of the abandoned channel or bed of the New River and bounded on each side by the lands hereinafter described and intended to be hereby granted Together with the pipes fences bridge in or upon the said piece or parcel of land

Secondly All that messuage or tenement with barns stables outbuildings and appurtenances thereunto belonging situate at Clayhill Tottenham aforesaid Together with the several pieces parcels of land thereunto belonging containing together by estimation Twenty five acres and nineteen perches formerly in the tenure or occupation of William Heath and now of Robert Rowley Chapman

And also All that Cottage with the garden and appurtenances thereto belonging formerly in the tenure or occupation of William Samuel Richards and now of James Sadler which said Cottage adjoins the said messuage or tenement lands and premises situate at Clayhill aforesaid all which said premises were subsequently in the occupation of Joseph Fletcher or his under tenants

And Thirdly All that messuage or tenement with the barns stables outbuildings appurtenances thereunto belonging situate at Clay Hill aforesaid together with two pieces thereto belonging and nearly adjoining containing by estimation Ten acres three roods and eighteen perches formerly in the occupation of John Thompson Esquire and now or late in the occupation of the said Robert Rowley Chapman with the exception of a small Paddock containing three roods and thirty one perches in the occupation of the said James Sadler Together with all buildings erections fixtures hedges ditches ways passages waters water courses mines minerals lights sewers drains rights easements and appurtenances to the said hereditments or any part thereof belonging or appertaining either actually or by reputation"

To hold the same unto and to the use of the Mortgagee in fee simple 

Provided always that if the said sum of Seventeen thousand seven hundred and forty pounds shall be paid on the said First day of April according to the foregoing covenant in that behalf the said premises shall at the request and cost of the Mortgagor his heirs or assigns be conveyed to him or them

And the Mortgagor hereby covenants with the Mortgagee that he the Mortgagor his heirs and assigns will forthwith commence proceed with and finish with all proper sewers drains and paths to the satisfaction of the Local Authority the new roads upon the aid premises such new roads being shown upon a plan approved of by the Mortgagee signed by the Mortgagor and Mortgagee and marked with the letter A

And also on or before the twenty ninth day of December One thousand eight hundred and ninety eight erect upon the said premises and completely finish fit for occupation at least fifty houses at a prime cost of not less than Three hundred pounds each on the blocks marked A B and C on the said plan marked A

and that he and they will in like manner erect and complete fifty further similar houses on or before the twenty fifth day of June One thousand eight hundred and ninety nine on the blocks marked H, I, J, and N, on the said plan

and that he and they will in like manner erect and complete fifty further similar houses on or before the twenty ninth day of December One thousand eight hundred and ninety nine on the blocks marked D and E on the said plan

and that he and they will in a like manner erect and complete fifty further similar houses on or before the twenty ninth day of December One thousand nine hundred on the blocks marked F, O, and K, on the said plan

and that he or they will in a like manner erect and complete twenty five houses further similar houses on or before the twenty ninth day of December One thousand nine hundred and one on the blocks marked L and M on the said plan

And also that all houses and other buildings to be erected upon the said premises shall be accordance with plans submitted to and approved by the Mortgagee who shall not withhold his approval except for good and sufficient reason

And also that all present buildings and all houses and other buildings to be erected upon on any part of the said premises when and so soon as they shall have been roofed in shall be insured in the full value thereof against loss or damage by fire by and at the expense of the Mortgagor in the Law Fire Insurance Office in the joint names of the Mortgagor and Mortgagee and shall be kept so insured by and at the expense of the Mortgagor during the continuance of this security and the Mortgagor shall at all times when required so to do by the Mortgagee produce the Policy or Policies and the last receipt for the premium or premiums thereof to to him or any person nominated by him and if default shall be made by the Mortgagor in the observance of this covenant the Mortgagee may himself insure and keep insured in manner aforesaid any houses or buildings in respect whereof such default shall have been made and all money expended by the Mortgagee for this purpose shall be repaid to the Mortgagee to the Mortgagor on demand together with interest thereon at the rate of five per cent per annum from the date of the same having been expended until the date of repayment thereof

And also that the Mortgagor shall not pull down or interfere with the existing buildings on the said premises or any of them until he shall repaid at least one moiety of the said principal sum of Seventeen thousand seven hundred and forty pounds

And also that he will not remove from the said premises brick earth brick clay or bricks but will use all bricks made upon the said premises for building the houses and other erections thereon

Provided always and it is hereby agreed and declared that payment of the principal money hereby secured shall not be required until the expiration of five years computed from the twenty ninth day of September One thousand eight hundred and ninety seven if in the meantime every quarterly payment of interest shall be made upon the day hereinbefore appointed for payment thereof or within one calendar month thereafter and all the covenants of the Mortgagor hereinbefore contained for making and completing the said New Roads with the sewers drains and paths and for the erection and completion of the houses agreed to be erected and completed by him and for keeping the said premises insured against loss or damage by fire and against pulling down or interfering with the existing buildings or removing brick earth brick clay or bricks from the said premises shall be duly observed and performed But upon any sale made under the Statutory Power in that behalf before the expiration of the aforesaid period the Purchaser shall not be bound or concerned to see or enquire whether such sale is consistent with this proviso and if a sale is made in breach thereof the the title of the Purchaser shall not be impeached on that account

Provided always and it is hereby further declared and agreed that the Mortgagee shall and will from time to time upon receiving at least four weeks notice in writing from the Mortgagor requiring him to do so assure to a Purchaser or Purchasers any part or parcels of the said premises discharged from the said Mortgage Debt and Interest or any part thereof upon being paid all arrears interest due at the date or dates of such assurance or assurances and being paid on account of the principal money for the time being due and being owed to him not less than one thousand pounds per acre of land so assured and so in proportion for any less quantity than an acre But the Mortgagee shall not be required to join in the assurance in any of the existing buildings unless and until at least one moiety of the said principal sum of Seventeen thousand seven hundred and forty pounds shall have been repaid And upon any payment of principal as aforesaid the the several sums hereinbefore covenanted to be paid by way of interest shall as from the date of such payment be respectively reduced in proportion to the amount repaid to the Mortgagee on account of the Principal

Provided also and it is hereby further agreed and declared that subject to the provision hereinbefore contained for the continuance of the loan for five years nothing hereinbefore contained shall prejudice or effect the right of the Mortgagee to call in the principal moneys hereby secured either on the day hereinbefore appointed for their payment or at any time subsequently

Provided always and it is hereby lastly agreed and declared that the Mortgagor shall be permitted to make bricks upon the said premises for the building of the houses and other erections thereon and to that end the brick earth or brick clay in the said premises
