CONVEYANCE

This Indenture made the twenty seventh day of March One thousand eight hundred and ninety nine Between WILLIAM JOHN MACQUEEN of Army & Navy Mansions Victoria Street in the County of Middlesex Brick Merchant of the one part and JOHN EDWARD FORD of 1 Westbourne Gardens Porchester Square in the said County of Middlesex Gentleman of the other part

Whereas by an Indenture of Mortgage dated the ninth day of October One thousand eight hundred and ninety seven and made between the said William John Macqueen of the one part and the said John Edward Ford of the other part in consideration of the sum of Seventeen thousand seven hundred and forty pounds paid to the said William John Macqueen by the said John Edward Ford the said William John Macqueen covenanted with the said John Edward Ford for payment to the said John Edward Ford on the first day of April One thousand eight hundred and ninety eight of the sum of Seventeen thousand seven hundred and forty pounds and also for payment to him at the respective times therein mentioned of the respective sums therein mentioned by way of interest on the said principal sum and by the same Indenture the said William John Macqueen conveyed unto the said John Edward Ford

FIRST ALL that piece or parcel of land situate at Clayhill Tottenham in the County of Middlesex containing by admeasurement Seven acres and three roods or thereabouts and bounded on the north by Clayhill Road on the east by land belonging to the Ecclesiastical Commissioners and on the south and west by the premises hereinafter described which piece or parcel of land with the dimensions thereof are more particularly delineated and described in the plan drawn on the Conveyance thereof to the said William John Macqueen bearing date the twelfth day of May One thousand eight hundred and ninety seven and therein coloured pink

AND SECONDLY ALL those pieces or parcels of land hereditments and premises situate at Clayhill aforesaid containing by admeasurement Twenty seven acres and three roods or thereabouts and on the north side of White Hart Lane together with all messuages or tenements and any out buildings thereon which said premises secondly described were more particularly delineated and described in the plans drawn on the Conveyance thereof to the said William John Macqueen bearing date the eighth day of October One thousand eight hundred and ninety seven and thereon coloured pink as the same hereditments and premises firstly and secondly described were known as the Devonshire Hill Estate and were formerly described as

Firstly All that piece or parcel of land situate at Tottenham in the County of Middlesex containing by admeasurement One rood and five perches forming a portion of the abandoned channel or bed of the New River and bounded on each side by the lands thereafter described Together with the pipes fences and bridge in or upon the said piece or parcel of land

Secondly All that messuage or tenement with the barns stables outbuildings and appurtenances thereunto belonging situate at Clayhill Tottenham aforesaid Together with the several pieces or parcels of land thereunto belonging containing together by estimation Twenty five acres and nineteen perches formerly in the tenure or occupation of William Heath and then of Robert Rowly Chapman And also All that Cottage with the garden and appurtenances thereto formerly in the tenure or occupation of William Samuel Richards and now of James Sadler which said Cottage adjoins the said messuage or tenement land and premises situate at Clayhill aforesaid all of which premises were subsequently in the occupation of Joseph Fletcher or his undertenants

And thirdly All that messuage or tenement with the barns stables outbuildings and appurtenances thereunto belonging situate at Clayhill aforesaid together with the two pieces or parcels of land formerly three pieces thereto belonging and nearly adjoining containing by estimation Ten acres three roods and eighteen perches formerly in the occupation of John Thompson Esquire and then or later in the occupation of the said Robert Rowley Chapman with the exception of a small paddock containing three roods and thirty one perches in the occupation of the said James Sadler Together with all buildings erections fixtures hedges ditches ways passages water watercourses mines minerals lights sewers drains rights easements appurtances to the said hereditments or any part thereof belonging to or appertaining either actually or by reputation

To hold the same unto and to the use of the said John Edward Ford in fee simple subject to a proviso for the redemption thereof upon payment to the said John Edward Ford of the said sum of Seventeen thousand seven hundred and forty pounds in accordance with the covenant in that behalf thereinbefore contained And the Indenture now in recital also contained divers covenants and agreements by the said William John Macqueen for the erection of certain houses on certain parts of the said hereditments in the manner and by the respective dates therein mentioned (whereof at least fifty were to be completed for occupation on or before the twenty ninth day of December One thousand eight hundred and ninety eight) and otherwise for the purposes and to the effect therein mentioned

And whereas no houses have as yet been erected on the said hereditments pursuant to the covenant in the said Indenture of Mortgage

And whereas the said principal sum of Seventeen thousand seven hundred and forty pounds remains owing to the said John Edward Ford on the security of the said Indenture of Mortgage

And whereas the said William John Macqueen has agreed with the said John Edward Ford to release the said hereditments to him from all equity of redemption under the said Indenture of Mortgage in consideration of the said John Edward Ford releasing the said William John Macqueen in manner herein after mentioned from the said sum of Seventeen thousand seven hundred and forty pounds so owing on the security of the said Indenture of Mortgage and all interest henceforth to accrue due thereon and from all present and future liability under the covenants and agreements on the part of the said William John Macqueen contained in the same Indenture of Mortgage but so nevertheless that the said sum of Seventeen thousand seven hundred and forty pounds so owing as aforesaid shall be kept on foot as a subsisting Charge on the said hereditments for the benefit of the said John Edward Ford his heirs and assigns hereinafter appearing

Now this Indenture Witnesseth that in pursuance of the said agreement in this behalf and in consideration of the release by the said John Edward Ford hereinafter contained the said William John Macqueen as beneficial owner doth hereby grant convey and release unto the said John Edward Ford

All and Singular the hereditments and premises comprised in or expressed to be assured by the said Indenture of Mortgage or which are now by any means vested in the said William John Macqueen subject to redemption by virtue thereof

To hold the same unto and to the use of the said John Edward Ford his heirs and assigns in fee simple free from all right or equity of redemption and from all claims and demands under the said Indenture of Mortgage

And this Indenture also Witnesseth that in pursuance of the said agreement and in consideration of the said conveyance and release by the said William John Macqueen hereinbefore contained the said John Edward Ford doth hereby release the said William John Macqueen his heirs executors and administrators from the said sum of Seventeen thousand seven hundred and forty pounds owing on the security of the said Indenture of Mortgage as aforesaid and all interest to accrue due thereon and from all present and future liability under the covenants and agreements on the part of the said William John Macqueen his heirs executors administrators or assigns contained in the same Indenture of Mortgage and from all actions proceedings costs claims demands and liability under the same Indenture of Mortgage

Provided always that it is hereby declared that the said sum of Seventeen thousand seven hundred and forty pounds and the interest to accrue due in respect thereof shall not merge in the equity of redemption of the said hereditments and premises but shall be considered and kept on foot as a subsisting Charge on the same hereditments and premises and shall be vested in the said John Edward Ford his executors administrators and assigns in trust for him the said John Edward Ford his heirs and assigns and so as to protect him and them against all mesne incumbrances charges and estates if any such there be
