This Indenture made the twenty sixth day of March One thousand nine hundred Between Henry Kerby of 4 Lancaster Place Strand in the County of London Gentleman of the one part and John Edward Ford of 1 Westbourne Gardens Porchester Square in the Parish of Paddington Gentleman of the other part

Whereas by an Indenture dated the ninth day of October One thousand eight hundred and ninety seven and made between William John Macqueen of the one part and the said John Edward Ford of the other part in consideration of the sum of Seventeen thousand seven hundred and forty pounds paid by the said John Edward Ford to the said William John Macqueen the freehold hereditments hereinafter described were inter alia conveyed by the said William John Macqueen unto and to the use of the said John Edward Ford in fee simple subject to a proviso for the redemption thereof upon payment to the said John Edward Ford his executors administrators or assigns of the said sum of Seventeen thousand seven hundred and forty pounds with interest for the same as therein expressed

And whereas by an Indenture dated the twenty seventh day of March One thousand eight hundred and ninety nine and made between the said William John Macqueen of the one part and the said John Edward Ford of the other part the said hereditments were granted conveyed and released unto and to the use of the said John Edward Ford his heirs and assigns in fee simple free from all right and equity of redemption and from all claims and demands under the hereinbefore recited Indenture of Mortgage and it was by the Indenture now in the recital declared that the said sum of Seventeen thousand seven hundred and forty pounds and the interest to accrue in respect thereof should merge in the equity of redemption of the said hereditments and premises as should be considered and kept on foot as a subsisting charge on the same as to protect him and them against all mesne incumbrances and charges if any such there were

And whereas by an Indenture of even date and made between the said John Edward Ford of the one part and the said Henry Kerby of the other part the said hereditments were granted and conveyed by the said John Edward Ford unto the said Henry Kerby his heirs and assigns forever together with the benefit of the said recited Declaration and the protection against any mesne incumbrance thereby afforded

And whereas the said John Edward Ford has agreed with said Henry Kerby to lend to him the sum of Fifteen thousand pounds upon having the repayment thereof with interest at the rate hereinafter mentioned secured in a manner hereinafter appearing

Now this Indenture witnesseth in pursuance of the said agreement and in consideration of the sum of Fifteen thousand pounds paid to the said Henry Kerby by the said John Edward Ford on or before the execution of the presents the receipt whereof the said Henry Kerby hereby acknowledges the said Henry Kerby hereby covenants with the said John Edward Ford to pay to him on the twenty ninth day September next the sum of Fifteen thousand pounds with interest thereon in the meantime after the rate of four pounds per cent per annum computed from the dates of these presents and also so long after that date as any principal money remains due under these presents to pay to him on the principal sum for the time being owing after the same rate by equal half yearly payments on the twenty fifth day of March and the twenty ninth day of September

And this Indenture also witnesseth that for the consideration aforesaid the said Henry Kerby as Beneficial Owner hereby grants and conveys unto the said John Edward Ford

All that parcel of land situate at Devonshire Hill (formerly Clayhill) Tottenham in the County of Middlesex containing by admeasurement Thirty four acres one rood or thereabouts together with the messuages premises and buildings erected thereon which said parcel of land is more particularly delineated and described on the plan drawn on the second skin of an Indenture of Conveyance of even date and made between the said John Edward Ford of the one part and the said Henry Kerby of the other part and thereon colored Pink

To hold the same unto and to the use of the said John Edward Ford in fee simple together with the benefit of the said recited Declaration and the protection so far as relates to the hereditments hereby conveyed

Provided always that if the said sum of Fifteen thousand pounds shall be paid on the said twenty ninth day of September next according to the foregoing covenant in that behalf the said hereditments and premises shall at the request and at the cost of the said Henry Kerby his heir executors administrators and assigns be reconveyed to him or them

And the said Henry Kerby hereby covenants with said John Edward Ford his executors administrators and assigns that he the said Henry Kerby his heirs and assigns will at all times during the continuance of the security keep all existing houses and buildings on the said premises insured against loss or damage by fire in the Imperial Fire Office or in some other Insurance Office to be approved by the said John Edward Ford his executors administrators or assigns in the full value thereof and will on demand produce to him or them the policy of such insurance and the receipt for every premium payable in respect thereof

And it is hereby declared that no Lease for a longer period than seven years by the said Henry Kerby his heirs or assigns of the said premises or any part thereof during the continuance of this security shall have effect by force or virtue of section 18 of the Conveyancing and Law of Property Act 1881 unless the said John Edward Ford his executors administrators or assigns shall consent thereto in writing

Provided always and it is hereby declared that payment of the principal money hereby secured shall not be required until the expiration of three years computed from the date hereof if in the meantime any payment of interest shall be made on the day hereinbefore appointed for payment thereof or within one calendar month thereafter and all the covenants herein contained or implied of the said Henry Kerby his heirs executors or assigns shall be duly observed and performed other than the covenant for the payment of the principal sum of Fifteen thousand pounds but upon any sale made under the statutory power of sale in that behalf before the expiration of the aforesaid period the Purchaser shall not be bound or concerned to see or enquire whether such sale is consistent with this proviso and if a sale is made in breach thereof the title of the Purchaser shall not be impeached on that account

Provide always and is hereby further agreed and declared that the said John Edward Ford his heirs administrators or assigns shall and will from time to time upon receiving at least one calendar months notice in writing from the said Henry Kerby his heirs or assigns requiring him so to do and at the cost of the said Henry Kerby his heirs or assigns reconvey to him or them or assure to a Purchaser or Purchasers any one or all of the several plots of land (being portions of the said hereditments and premises) marked on the plan on the second skin hereof and numbered respectively 1 to 18 or any portion of any one of the same provided the portion so taken shall extend from the frontage of the said plot throughout its entire depth freed and discharged from the said Mortgage debt and interest upon being paid in reduction of the said principal sum the sum of money set opposite to the number of the plot or plots so to be reconveyed or assured in the second column of the Schedule hereto or a sum of money bearing the same ratio to the sum of money set opposite to the number of the plot a portion of which is to be reconveyed or assured as aforesaid as the quantity of land to be reconveyed or assured bears to the entire plot as the case may be according to whether the said John Edward Ford is requested to reconvey or assure the entirety of any plot or plots or only a portion of a plot together with all arrears of interest due in the principal sum for the time being remaining owing and also all interest to the date of such reconveyance or assurance on the sum so paid off
