This Indenture made the fifteenth day of July One thousand nine hundred and twelve Between Samuel South of Langhedge House 43 Snells Park Edmonton in the County of Middlesex Esquire (hereinafter called "the borrower") of the one part and Samuel William Pedley of 23 Bush Lane in the City of London Solicitor and Charles May of 23 Bush Lane in the City of  London aforesaid Solicitor (hereinafter called "the Mortgagees") of the other part

Whereas the Borrower is seized of the hereditments hereinafter mentioned and intended to be hereby mortgaged for an estate in fee simple free from incumbrances

And whereas the Mortgagees have agreed with the Borrower to lend to him the sum of Three thousand pounds upon having the repayment thereof with interest secured in manner hereinafter appearing

Now this Indenture Witnesseth that in pursuance of the said recited agreement and in consideration of the sum of Three thousand pounds now paid to the Borrower by the Mortgagees out of moneys belonging to them on a joint account (the receipt whereof the Borrower hereby acknowledges) the borrower hereby covenants with the Mortgagees to pay to them on the Thirtieth day of September next the sum of Three thousand pounds with interest thereon in the meantime at the rate of Four pounds ten shillings per cent per annum compute from the date of these presents And further if the said money shall not be paid to pay to them interest at the rate aforesaid by equal quarterly payments on the Thirtieth day of September the Thirty first day of December the Thirty first day of March and the Thirtieth day of June in every year on the principal moneys for the time being remaining due on this security

And this Indenture also witnesseth that in further pursuance of the said recited agreement and for the consideration aforesaid the Borrower as Beneficial Owner grants unto the Mortgagees

First All and singular those pieces or parcels of Freehold land situate at Devonshire Hill (formerly Clay Hill) Tottenham in the County of Middlesex containing by estimation Thirty four acres or thereabouts Together  with the messuages premises and buildings erected thereon

And secondly All that piece or parcel of land being part of a New Road called or intended to be called White Hart Parade in the Parish of Tottenham in the County of Middlesex which said pieces or parcels of land First and secondly hereinbefore described are for the purposes of identification only and not of grant delineated in the plan drawn on an Indenture of Conveyance dated the Fifteenth day of July One thousand nine hundred and twelve and made between William John Jennings and Herbert Edwin Hornby of the one part and the Borrower of the other part and thereon coloured Pink and Green respectively

To hold the same unto and to the use of the Mortgagees in fee simple subject as to the piece of land secondly hereinbefore described to such rights if any as one Thomas Peter Green his heirs executors administrators or assigns maybe entitled to as being the owner or owners of the land coloured Blue on the said plan and subject as to all the hereditments hereby conveyed to the proviso for the redemption hereinafter contained

Provided always and it is hereby agreed and declared that if the Borrower his heirs executors administrators or assigns shall on the said Thirtieth day of September next pay to the Mortgagees their executors administrators or assigns the said sum of Three thousand pounds with interest thereon in the meantime at the rate aforesaid the Mortgagees their executors administrators or assigns shall at any time thereafter upon the request and at the cost of the Borrower his heirs executors administrators or assigns reconvey the said hereby assured to the use of the Borrower his heirs or assigns

And the Borrower hereby covenants with the Mortgagees that he the Borrower his heirs executors administrators or assigns shall not during the continuance of this security open work or dig for any mines minerals quarries clay gravel sand or brickearth in upon or under the hereditments and premises hereby conveyed without the consent of the Mortgagees their executors administrators or assigns  first had and obtained

And also that he the borrower his heirs executors administrators or assigns will during the continuance of the present security keep the said messuages buildings and premises comprised in or subject to this security and all messuages buildings and premises and property which may from time to time be so comprised or in good and substantial repair and also insured against loss or damage by fire to the full value thereof in the Hand-in-Hand branch of the Commercial Union Fire Insurance Office or in some other Insurance Office of repute to be approved of in writing from timte to time by the Mortgagees their executors administrators or assigns and will duly and punctually pay all premiums and moneys necessary for effecting and keeping up the said Insurance when the same shall become due or within one week thereafter and will on demand produce to the Mortgagees their executors administrators or assigns the policy or policies of such insurance and the receipt for every such payment And that if default shall at any time be made by the Borrower his heirs executors administrators or assigns in effecting or keeping up such insurance as aforesaid or in keeping the said premises or any part thereof in good and substantial repair or in producing any such policy or receipt to the Mortgagees their executors administrators or assigns on demand it shall be lawful for but not obligatory on the Mortgagees their executors administrators or assigns to insure and keep insured the said premises or any part thereof in the full value thereof and repair and keep in repair the same and to enter upon the said mortgaged premises for that purpose

And that all moneys expended by them for that purpose together with interest thereon at the rate of Four pounds ten shillings per cent per annum shall  on demand be repaid to them by the Borrower his heirs executors administrators or assigns and until such repayment shall be a Charge upon all the said premises hereby mortgaged

And further that during the continuance of this security no person persons or Corporation shall be registered as proprietor or proprietors of the hereditments hereby mortgaged or any part thereof without the consent in writing of the Mortgagees their executors administrators or assigns and that if this covenant shall be broken the principal moneys hereby secured shall become immediately payable and the provisions of Section 20 of the Conveyancing & Law of Property Act 1881 shall not apply to this security

Provided always and it is hereby agreed that the Mortgagees their heirs executors administrators and assigns or any of them shall not be answerable for any involuntary losses which may happen in or about exercise or execution of the power of Sale or any of the powers or or trusts which may be vested in them by value of these presents or any Statute

And it is hereby agreed that the Borrower his executors administrators or assigns shall not except with the written consent of the Mortgagees or the person or persons deriving title under them exercise the powers of leasing or letting or agreeing to to lease or let conferred by the said Conveyancing and Law of Property Act 1881 on a Mortgagor while in possession but it shall not be necessary to express such consent in any such Lease provided that no such consent shall be required in respect of any tenancy not exceeding Three years at a rack rent

Memorandum that on the 11th July 1916 the sum of Five hundred pounds was paid by the Borrower in reduction of the principal money owing on the security of the within written Indenture leaving the sum of Two thousand five hundred pounds still due and owing

This Indenture made on the 26th day of May One thousand nine hundred and twenty Between the before named Samuel William Pedley and Charles May (hereinafter called the Mortgagees) of the one part Samuel South of River House Devonshire Hill Lane White Hart Lane Tottenham in the County of Middlesex Pottery Manufacturer and Robert Buckle of "Rosslyn" Wilton Road Merton in the County of Surrey Solicitors' Clerk (hereinafter called the Borrowers) of the other part

Whereas the before named Samuel South died on the second day of January One thousand nine hundred and nineteen having by his Will which was dated the twenty third day of June One thousand eight hundred and ninety nine appointed the Borrowers to be the Executors and Trustees thereof and the said Will (with a Codicil which did not affect the appointment of the said Executors) was proved in the Principal Probate Registry by the Borrowers on the Second day of July One thousand nine hundred and nineteen

Now this Indenture witnesseth that in consideration of the Borrowers having paid to the Mortgagees out of moneys forming part of the Estate of the said Samuel South deceased all moneys owing on the security of the before written Indenture (the receipt whereof the Mortgagees hereby acknowledge) the Mortgagees as Mortgagees hereby convey unto the Borrowers  All and singular the pieces or parcels of freehold land described in and conveyed by the before written Indenture To hold the same unto and to the use of the Borrowers in fee simple freed and discharged from all principal moneys and interest secured by and from all claims and demands under the said the Indenture as part of the estate of the said Samuel South deceased
